The Karkardooma Court on Thursday directed the Delhi Police to clearly spell out the alleged role of each accused person while presenting rebuttal arguments in the 2020 North East Delhi riots larger conspiracy case being heard under the Unlawful Activities (Prevention) Act (UAPA).

The direction came as the court continued hearing arguments on the framing of charges in one of the most closely watched cases linked to the February 2020 communal violence in the national capital.

Additional Sessions Judge Sameer Bajpai granted time to the Delhi Police to present detailed rebuttal submissions and listed the matter for May 30. The court specifically asked the prosecution to address the allegations against every accused individually, as mentioned in the charge sheets filed in the case.

The proceedings are currently focused on arguments related to the framing of charges against multiple accused persons named in the alleged larger conspiracy behind the North East Delhi riots. After completion of rebuttal arguments by the prosecution, the court may reserve its order on whether charges are to be formally framed.

Advocate Anirudh Mishra appeared as Special Public Prosecutor for the Delhi Police during the hearing.

The matter reached the rebuttal stage after the court heard detailed submissions from counsel representing the accused persons earlier this month.

Several accused named in UAPA charge sheets

The Delhi Police has filed charge sheets against Tahir Hussain, Umar Khalid, Sharjeel Imam, Abdul Khalid Saifi, Shifa Ur Rehman, Meeran Haider, Saleem Khan, Salim Malik alias Munna, Asif Iqbal Tanha, Devangana Kalita, Natasha Narwal, Faizan Khan, Safoora Zargar, Ishrat Jahan, Gulfisha Fatima, Tasleem Ahmed, and Athar Khan in connection with the larger conspiracy case.

The accused have been booked under various provisions of the UAPA and other sections linked to the violence that broke out in North East Delhi in February 2020, leaving several people dead and many injured.

The development comes days after the Karkardooma Court rejected the interim bail plea filed by former JNU student leader Umar Khalid in the same case.

Additional Sessions Judge Sameer Bajpai dismissed the application on May 19, observing that the grounds cited for temporary bail were not reasonable enough to justify release.

Umar Khalid had sought interim bail for 15 days under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), read with Section 439 of the CrPC. The plea sought permission for him to attend the 40th day ritual, or Chehlum, of his uncle and to assist his mother, who is scheduled to undergo surgery.
